By accessing or using bayitGO, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Service

bayitGO provides a property compliance tracking platform for NYC property owners and property managers. Our service aggregates publicly available data from NYC government agencies to help users monitor violations, complaints, permits, inspections, and compliance status.

Additional features include AI-powered explanations, compliance scoring, report generation, team collaboration, file management, notifications, calendar exports, interactive maps, contractor management, and property risk asset tools. Feature availability varies by subscription plan.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and complete information
• Notifying us of any unauthorized use of your account

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Resell or redistribute the service without permission
• Circumvent usage quotas or plan restrictions
• Use automated tools to scrape or bulk-extract data from the platform
• Upload malicious files, malware, or content that violates any law
• Share account credentials or team access with unauthorized individuals

5. Intellectual Property

The bayitGO Compliance Score, including its methodology, algorithms, and calculations, is proprietary intellectual property of bayitGO. You agree not to:

• Reverse-engineer, decompile, or attempt to derive the scoring methodology
• Copy, reproduce, or create derivative works based on the Compliance Score system
• Use the Compliance Score or its methodology for competing products or services
• Scrape, export, or systematically collect Compliance Scores for use outside the platform

All trademarks, service marks, logos, and trade names displayed on bayitGO are our property. All software, algorithms, designs, and content are protected by intellectual property laws.

6. Data Accuracy

bayitGO retrieves data from government sources and public records. While we strive for accuracy, we do not guarantee that all information is complete, current, or error-free. Users should verify critical information with official sources. Government agencies may update, correct, or remove data at any time, and there may be delays between official records and our display.

7. AI-Generated Content

bayitGO uses artificial intelligence to provide violation explanations, complaint summaries, and remediation suggestions. AI-generated content is for informational purposes only and may contain errors. You acknowledge that AI suggestions do not constitute professional, legal, or expert advice. Always verify AI-generated information with official sources and consult licensed professionals before taking action.

AI features are subject to usage limits and are available on eligible subscription plans only. We reserve the right to adjust these limits at any time.

8. Generated Reports and Forms

bayitGO generates compliance reports and auto-filled regulatory forms. These generated documents:

• Are based on data retrieved from public sources and may not reflect the most current information
• Should be reviewed carefully before submission to any government agency
• Do not constitute legal filings and may require additional information or corrections
• Are provided as a convenience tool, not as a substitute for professional compliance services

9. User-Uploaded Content

You may upload files to associate with your properties. You are solely responsible for ensuring that:

• You have the right to upload and share the content
• The content does not violate any laws, regulations, or third-party rights
• The content does not contain malware or malicious code

Uploads are subject to file type and size restrictions. We reserve the right to remove content that violates these terms.

10. Team Features and Data Sharing

Team features allow multiple users to collaborate on property management. By creating or joining a team, you acknowledge that:

• Property data, violations, files, and compliance information will be shared with all team members
• Team administrators can manage member access and permissions
• You are responsible for inviting only authorized individuals to your team
• Removing a team member revokes their access but does not delete data they contributed

11. Notifications and Communications

bayitGO may send you notifications via email, SMS, push notifications, and in-app alerts regarding compliance issues, deadlines, score changes, team activity, and service updates.

Certain notification channels are available on eligible subscription plans. You can manage your notification preferences in your account settings. By providing your phone number, you consent to receiving SMS messages. Standard message and data rates may apply.

12. Subscription and Billing

Paid subscriptions are billed monthly or annually as selected. You may cancel at any time, and your subscription will remain active until the end of the billing period. Refunds are provided at our discretion.

Different subscription tiers provide access to different features, data sources, property limits, and usage quotas. Downgrading your plan may result in loss of access to certain features and data. We reserve the right to modify plan pricing and features with reasonable notice.

13. Usage Limits and Fair Use

To ensure quality service for all users, bayitGO enforces usage limits on properties, AI features, API requests, bulk operations, and file uploads based on your subscription plan.

We reserve the right to throttle, suspend, or restrict access for users who exceed fair use thresholds or attempt to circumvent limits.

14. Risk Assets

The Risk Assets feature allows users to explore compliance data for properties they may not own. This feature uses publicly available data and is intended for legitimate purposes such as due diligence, investment research, and portfolio management. You agree not to use Risk Assets for harassment, stalking, discrimination, or any unlawful purpose.

15. Limitation of Liability

bayitGO is provided "as is" without warranties of any kind. We are not liable for any damages arising from your use of the service, including but not limited to fines, penalties, or legal consequences resulting from compliance decisions made using our platform, AI-generated suggestions, auto-filled forms, or generated reports.

16. Changes to Terms

We may modify these terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the service after changes constitutes acceptance of the new terms.

17. Termination

We reserve the right to suspend or terminate your account for violations of these terms or for any reason at our discretion. Upon termination, your right to use the service ceases immediately. You may request export of your data prior to account deletion.
